Source: S.I. No. 233/2025 – Protected Disclosures Act 2014 (Disclosure to Prescribed Persons) (Amendment) Order 2025
The PROTECTED DISCLOSURES ACT 2014 has been amended with a new statutory Instrument SI No.233 of 2025 “PROTECTED DISCLOSURES ACT 2014 (DISCLOSURE TO PRESCRIBED PERSONS) (AMENDMENT) ORDER 2025” which passed in April 2023 and entered into force on 26 May 2025. It updated the list of prescribed persons.
The order updates and clarifies existing prescribed persons and their remits, including:
- The CEO of Rásaíocht Con Éireann, with responsibility for matters relating to the management and development of the greyhound industry.
- The Company Secretary of the Irish Aviation Authority, with an expanded and clarified remit covering civil aviation safety, security, airspace management, aviation charges, travel trade licensing, airline and ground-handling licensing, slot allocation, and enforcement of EU air passenger rights.
- The CEO of the Personal Injuries Resolution Board, reflecting changes under the Personal Injuries Resolution Board Act 2022.
- The CEO of the Road Safety Authority, with a comprehensive remit covering driver licensing, vehicle standards, road safety, transport enforcement, tachographs, posting of drivers, and driver training.
Removes one prescribed person (this looks to be the Commissioner for aviation regulation).
Adds two new prescribed persons:
- 1) The Secretary General of the Department of Defence, for matters relating to the award of defence and security contracts under EU procurement rules.
- 2) The CEO of An Rialálaí Agraibhia, for matters relating to unfair trading practices in the agricultural and food supply chain under the 2023 Regulations.
