Spain officially launches the Independent Whistleblower Protection Authority (AIPI) to oversee compliance with national and EU whistleblowing obligations.

On 1 September 2025, Spain launched the Independent Whistleblower Protection Authority Autoridad Independiente de Protección del Informante – AIPI. The new authority is responsible for monitoring compliance with Spain’s Whistleblower Protection Act (Ley 2/2023) and ensuring alignment with the EU Directive on Whistleblowing (Directive 2019/1937). Companies are now under strict obligations to register designated officers managing internal reporting channels.

Key Highlights:

  • AIPI officially established and operational from 1 September 2025.
  • All companies within scope must notify AIPI by 1 November 2025 of their designated reporting channel officer.
  • Any subsequent change of officer must be reported within 10 working days, with reasons provided.
  • Launch follows Ministerial Order PJC/908/2025 published in the State Gazette on 12 August 2025.
  • Until the Authority has its own budget, its activities will be financed with the budgetary appropriations of the Ministry of the Presidency, Justice, and Relations with Parliament (article 3 Orden PJC/908/2025)

“The allocation of adequate budgetary and staffing resources to the Independent Authority for the Protection of Whistleblowers is essential to ensure a truly functional protection system. It represents a major step forward in consolidating trust, independence, and integrity in the protection of whistleblowers. Until the Authority has its own budget, its activities will be financed with the budgetary appropriations of the Ministry, which evidences that, even though the Authority is already operational, it still faces certain limitations.”

Spain adopted the Whistleblower Protection Act (Ley 2/2023, de 20 de febrero, reguladora de la protección de las personas que informen sobre infracciones normativas y de lucha contra la corrupción) in February 2023 to transpose Directive 2019/1937. The launch of AIPI strengthens enforcement by introducing an independent oversight body with clear monitoring powers. This development coincides with the European Commission’s wider consultation on an Action Plan for Whistleblower Protection, opened in August 2025, which aims to strengthen protections across the EU.
