New report highlights challenges in implementing whistleblower protection in Bulgaria

A new paper “Beyond Paper Rights: Implementing Whistleblower Protections in Central and Eastern Europe,” published by the Central and Eastern European Law Initiative Institute raises concerns regarding the transposition of the EU Directive on Whistleblowing in Bulgaria, Czechia, Hungary, Poland, Slovakia, and Romania. 

The report examines the current state of implementation and identifies challenges and opportunities for ensuring effective protection in the region. 

With Bulgaria, the report concludes:  

“As the Bulgarian Institute of Legal Initiatives explained in the Speaking Up report: 

“The concept of whistleblowing and its protection is relatively new for the Bulgarian society. As a consequence, whistleblowing as a construction still opens some interesting debates, provoked by the communist past.” 

Thus, while the now-adopted EU Directive is an important step forward, the nature of the law and its practical implementation–has to date been imperfect. Further law reform and improved administrative guidance, developed through proper, consultative processes, will be necessary to ensure the effectiveness of the EU Directive in practice”
