New Analysis on Draft Law published

Following the adoption of new legislation to transpose the EU Directive on Whistleblowing on 16 May 2023,  the Government of Luxembourg has published a new informative overview on the country’s whistleblowing framework. The information includes leaflets published in EnglishFrench and Luxembourgish.

The overview includes the objectives, scope and conditions for protection under the Act, internal and external reporting channels and a new information video.

The overview also includes information on a new reporting office provided for by the new law and set up under the remit of the Minister of Justice. It confirms the tasks of the office include:

  • Raising public awareness of whistleblower protection law
  • Inform and assist anyone; wishing to make a report, in particular by specifying the procedures to be followed
  • Inform the respective; competent authorities of any reported failures to comply with obligations to set up internal channels;
  • Collect from the competent authorities and the judicial authorities the information necessary for the preparation of an annual report;
  • To make recommendations on any matter relating to the application of the law; and
  • Carry out the tasks assigned under external reporting procedures

The overview states that the Reporting Office was due to be in operation from 1 September 2023.
